Facts:
Defendant was convicted of petit larceny and the court took under advisement the question of whether the crime of conspiracy to commit a misdemeanor existed in Virginia, and, if so, whether it was a lesser included offense of the conspiracy for which defendant was indicted.

Holdings:
The Virginia Court made the following holding:
- At common law, in misdemeanors, there are no accessories, all concerned being principals. Any person who is proven to have had the requisite mental state and to have done sufficient acts to have criminal liability is a principal; otherwise, he is innocent.
- The Supreme Court of Virginia has defined “conspiracy” as an agreement between two or more persons by some concerted action to commit an offense.
- Under the common law of England a conspiracy to commit a misdemeanor is an offense; in fact, the common law in many instances punished a conspiracy to commit an act that was unlawful but not criminal. Every confederacy to injure individuals, or to do acts which are unlawful, or prejudicial to the community, is a conspiracy. There can be no doubt, but that all confederacies whatsoever, wrongfully to prejudice a third person, are highly criminal at common law. If a conspiracy to commit a wrongful, but not criminal, act is a crime, a conspiracy to commit a misdemeanor is a crime.

Criminal Misdemeanor Virginia Fairfax Lawyers Suspended Sentenced Fine Code 18.2-456
Clemant v. Commonwealth

Holdings:
The Virginia Court made the following holding:
- Va. Code Ann. § 19.2-237 states a defendant shall not be sentenced to jail in absentia. The general assembly recognizes that there are important policy considerations which suggest that the system of justice would be better served by delaying the imposition of sentence, than by sentencing a defendant in his absence. Va. Code Ann. § 19.2-237 specifically addresses presentments and indictments for misdemeanor, but it also applies to misdemeanors tried on a warrant or summons.
- The presence of the defendant at sentencing indicates that society has sufficient confidence in the justness of its judgment to announce it in public to the convicted man himself. Presence thus enhances the legitimacy and acceptability of both sentence and conviction. It is advantageous to the defendant that the decision maker be required to face him. The prohibition against sentencing in absentia permits the defendant to present and challenge evidence and makes him publicly accountable for his conduct.
